Taylor Duane Barton & Gilman attorneys represent potentially responsible parties in environmental law actions brought by federal and state regulatory agencies. In the area of toxic tort litigation, our lawyers represent clients involved in Massachusetts and Rhode Island cases involving a wide variety of allegedly hazardous materials.
Our attorneys are recognized for taking on tough naval and commercial asbestos exposure cases and have a deep knowledge of the state-of-the-art medical, scientific and fiber issues raised in these types of cases
Taylor Duane’s team of environmental and toxic tort litigators defend the following types of cases:
- Superfund claims.
- State hazardous waste liability laws.
- Environmental cost-recovery actions.
- Hazardous waste cleanups.
- Remediation cases.
- Damage from underground storage tanks.
- Asbestos claims.
- Mold.
- Lead liability.
- Corporate witness preparation.
In one notable case, Taylor Duane attorneys helped a large commercial construction company defeat a seven-figure property damage claim involving claims of alleged environmental contamination.
In a personal injury case involving alleged exposure to asbestos on construction sites, Taylor Duane attorneys persuaded the Rhode Island Superior Court to grant summary judgment to the firm’s clients based on the argument that the lawsuit was untimely under the Rhode Island Statute of Repose. As a consequence of this ruling, asbestos claims against building contractors in Rhode Island have all but stopped.
In addition, our attorneys have successfully persuaded the Rhode Island Supreme Court to dismiss 36 cases involving Canadian plaintiffs whose asbestos claims had no connection to Rhode Island.
