Firm obtains defense verdict dismissing claims in condominium dispute

BOSTON (April 28, 2011) – Lauren J. Regis recently obtained a defense verdict on behalf of a condominium association, dismissing the complaint filed by a husband and wife who owned a unit in the condominium.

Following a full-day trial, a Massachusetts District Court judge rejected the unit owners’ claims, including allegations that the condominium association unfairly required them to pay their own water bill, and that the association failed to make repairs to both their unit and common area as required by the Master Deed.

The Master Deed for the condominium authorized the association to require the unit owners to pay for their water service because their water line was exclusive to their unit, unlike the water line shared by the remaining units in the condominium.
