Smith Holtslag quoted in National Law Journal article on $28M summary judgment win

BOSTON (March 3, 2011) – Partner Tamara Smith Holtslag was recently quoted by the National Law Journal in an article reporting a federal judge's denial of a claim for $28 million in insurance coverage.

On behalf of its client Lexington Insurance Company, Taylor Duane recently obtained summary judgment in federal court in Massachusetts denying an insurance coverage claim brought by UnitedHealth Group under a managed care professional liability policy issued by Lexington. U.S. District Court Judge Nancy Gertner found that Lexington did not receive sufficient notice of an underlying lawsuit and associated expenses, totaling over $28 million. As a result, it was not obligated to pay UnitedHealth because its rights under the insurance policy were prejudiced.

Smith Holtslag is lead counsel in the case, and Allan Taylor, Frank Connor and Scarlett Rajbanshi are also working on the matter.
