
Article analyzing “independent contractor” exclusion published in Claims Magazine
BOSTON (Feb. 1, 2011) – An article by James J. Duane III and Andrew C. Coulam analyzing the independent contractor exclusion in commercial liability policies has been published online by Claims Magazine at www.propertycasualty360.com.
In the article, Duane and Coulam assess the scope of the exclusion and provide tips to insurance claims professionals on how to effectively apply the clause when addressing claims for coverage.
The authors recently persuaded a Massachusetts Superior Court judge to enforce an insurance policy’s independent contractor exclusion against a restaurant owner seeking coverage for an electrician’s claim he was injured while working at the restaurant during renovations. Their Claims Magazine article examines the judge’s ruling, as well as other judicial interpretations of the exclusion.
