
Firm obtains defense verdict in wrongful death case
PROVIDENCE (Nov. 5, 2010) – John Barton and Angela Carr recently obtained defense verdicts on behalf of two obstetricians who allegedly had failed to timely deliver an unborn infant at risk, which the mother claimed resulted in the child’s stillbirth during the 37th week of gestation.
The mother in the wrongful death lawsuit alleged that she suffered from a rare hepatic condition known as cholestasis of pregnancy, which placed the child at greater risk of stillbirth. She further contended that her family history of cholestasis was made known to the obstetricians approximately five days before the stillbirth, when she began experiencing severe itching and other symptoms commonly associated with cholestasis.
However, following a two-week trial in the Bristol County Superior Court in Massachusetts, a panel of 13 jurors rendered verdicts in favor of both obstetricians on all counts of the mother’s complaint. The jury returned its verdicts for the physicians after only two hours of deliberation.
